TERMS AND CONDITIONS OF IMAGES AND PHOTOGRAPHY

Unauthorised reproduction of photographs or the duplication and/or plagiarism of text content is strictly prohibited. Malpas Farm Shop reserves the right to initiate legal action to protect its commercial interests.

TERMS AND CONDITIONS OF SALES
DEFINITIONS
1.1. "Buyer" means the person or entity who purchases or agrees to purchase Goods and/or Services from the Supplier.
1.2. "Consumer" is as defined in the Consumer Rights Act 2015.
1.3. "Contract" refers to the agreement between the Supplier and the Buyer for the sale and purchase of Goods and/or Services, incorporating these Terms and Conditions.
1.4. "Goods" are the items agreed to be bought by the Buyer from the Supplier.
1.5. "Services" are the services agreed to be bought by the Buyer from the Supplier.
1.6. "Supplier" is Malpas Farm Shop operating the website www.malpasfarmshop.co.uk. All complaints should be addressed in writing to office@malpasfarmshop.co.uk
1.7. "Terms and Conditions" are the terms of sale outlined in this document and any special terms agreed in writing by the Supplier.
1.8. "Website" refers to www.malpasfarmshop.co.uk
CONDITIONS
2.1. These Terms and Conditions do not affect the Buyer's statutory rights as a Consumer under the Consumer Rights Act 2015.
2.2. These Terms and Conditions shall apply to all contracts for the sale of Goods and/or Services by the Supplier, superseding any other documentation or communication from the Buyer.
2.3. Acceptance of Goods delivery is considered as acceptance of these Terms and Conditions by the Buyer.
2.4. Any variations to these Terms and Conditions are valid only if agreed in writing by the Supplier.
2.5. Specific conditions for Services are detailed in the Schedule to this agreement.
2.6. Complaints should be directed to the Supplier's address as stated in clause 1.6.

ORDERING
3.1. All orders for Goods and/or Services are considered an offer by the Buyer to purchase under these Terms and Conditions. Acceptance of any order is at the discretion of Malpas Farm Shop.
3.2. If ordered Goods are unavailable, Malpas Farm Shop will provide a substitute product of equal or greater value at no additional cost.
3.3. Promotional and discount codes can only be used once and may not be combined with other offers. Malpas Farm Shop reserves the right to withdraw or cancel a promotional code at any time if it's used improperly.
3.4. Returning customers must have a minimum order value of £50 to qualify for free delivery or other promotional offers, unless explicitly stated otherwise. This condition does not apply to new customer special offers.
3.5. Customers should verify all order details (items ordered, delivery and billing addresses, email address, phone number, and delivery date) before confirming their order.

PRICE AND PAYMENT
4.1. Prices, inclusive of VAT, are as stated on the Website and in marketing communications. Delivery charges are additional.
4.2. Total cost, including VAT and delivery, is displayed in the shopping cart before order confirmation. For phone orders, this total will be confirmed by our advisors.
4.3. Order confirmations will be sent via email, detailing the Goods/Services, price, and cancellation rights, particularly for Consumer purchases.
4.4. Payment, including VAT and delivery charges, is due at the time of ordering.
4.5. Late or failed payments may result in suspension of Services or delay in delivery.

PERFORMANCE OF SERVICES
5.1. Malpas Farm Shop will perform Services with due skill and care, but does not guarantee uninterrupted or error-free Services.
5.2. The product star rating system reflects genuine customer reviews. Inappropriate content may not be published.

RIGHTS OF SUPPLIER
6.1. Malpas Farm Shop may change prices and reserves the right to update them on the Website and marketing communications.
6.2. Goods/Services can be withdrawn from sale at any time.
6.3. Promotional or offer codes can be withdrawn or suspended at any time.
6.4. Malpas Farm Shop is not liable for withdrawing Goods/Services or refusing orders.

AGE OF CONSENT
7.1. Buyers must be of legal age for certain Goods/Services. By ordering, the Buyer confirms they meet the age requirement.
7.2. Orders from underage buyers will be cancelled immediately.

DELIVERY
8.1. If a set delivery date cannot be met, the Buyer will be notified for a new date or offered a refund.
8.2. While Malpas Farm Shop endeavours to meet delivery dates, it is not liable for any losses due to delivery delays.
8.3. Goods will be delivered to the specified address, and the Buyer should arrange to receive them.
8.4. Risk in Goods passes to the Buyer upon delivery.
8.5. Ownership of Goods transfers after full payment.

CANCELLATION AND RETURN
9.1. Orders for Goods can be cancelled up to 72 hours before dispatch. Services can be cancelled within 7 working days of contract creation. Refunds within 28 days.
9.2. Defective Goods must be returned within their use-by date for a refund or replacement.
9.3. Returned Goods must display the order number.

LIMITATION OF LIABILITY
10.1. Liability is limited to the purchase price of the Goods/Services, and indirect losses are not covered.
10.2. Liability for death or personal injury caused by negligence is not excluded.

WAIVER
No waiver of rights by Malpas Farm Shop should be considered a waiver of any future rights.

FORCE MAJEURE
Malpas Farm Shop is not liable for delays/failures caused by uncontrollable events.

SEVERANCE
Invalid terms will be severed, leaving the remainder effective.

CHANGES TO TERMS AND CONDITIONS
Malpas Farm Shop can modify these Terms, not affecting existing accepted Terms.

GOVERNING LAW AND JURISDICTION
These Terms are governed by the law of England and Wales.

Limited to 1 per customer/household. For queries, contact 01948 820528. Free standard delivery available under certain conditions. Orders to Channel Islands have specific customs tax conditions.

Malpas Farm Shop reserves the right to replace any offer with an equivalent or superior one. Offers cannot be used together unless specified.
